Please note: carefully read this form. This is a declaration in which you waive your rights in case you suffer any damage. By signing, you declare to waive your rights against Race Planet Amsterdam, Race Planet Delft, Race Planet Zandvoort, and its affiliated companies (hereinafter referred to as "BRP"), including third parties engaged by BRP, and you accept this.
1. Racing, circuit driving, and karting are highly dangerous activities!
1.1. You declare that you are aware that participating in BRP's activities and entering the location of these activities pose an increased risk of damage. Participation or visiting an activity can result in damage due to steering errors, collisions, cutting off, or due to careless actions or omissions of (fellow) participants. There is an increased risk of damage, including severe damage, such as physical injury or damage resulting from death. You accept this increased risk and expressly assume this risk.
1.2. By signing this form, you waive your right to make a claim against BRP, its employees, instructors, management, and the third parties engaged by BRP in its activities, such as Exploitatie Circuit Park Zandvoort B.V. and Bridgestone Europe NV/SA, if you suffer any damage. Your waiver of rights applies to damage of any kind, including injury or damage resulting from death, which may arise from participation in, visiting an activity of BRP, or from using facilities or services of BRP or third parties engaged by BRP. This indemnity applies under all circumstances, except in cases of intent or gross negligence on the part of BRP.
2. Instructions, regulations, and safety rules
2.1. It is your own responsibility to receive an explanation or instruction, pay attention during explanations and regulations, including safety and house rules, and comply with them. You are obliged to ask for an explanation if one is not provided, if you miss the explanation, or if you do not understand it. BRP employees are present to provide support, but this does not guarantee that emergencies or accidents can be prevented. You must keep an eye on the track, (parking) areas, and other participants.
2.2. You are required to wear the designated safety clothing, including a helmet. Long hair must be tucked away under the helmet. The helmet must fit well and be securely fastened before you start the activities. It is your own responsibility to ensure this.
2.3. You declare that an explanation, instruction, or regulations do not guarantee the prevention of emergencies and damages, including physical and/or mental injuries, are included. By signing this form, you indemnify BRP and the third parties engaged by it against any damage that may arise.
3. Insurance and medical expenses
3.1. You are obliged to have adequate insurance, including liability and health insurance. The consequences of inadequate coverage are at your own expense and risk.
3.2. By means of this declaration, you waive the right to compensation for any damage of any kind, including severe damage such as injury or death (see also article 1.2). You also waive the right to compensation for indirect damage, such as medical expenses (including co-payment), salary costs, loss of profit, etc.
4.Vehicles and participation with your own vehicle
4.1. If you participate in an activity of BRP with your own vehicle, you are responsible for the (technical) condition, maintenance, capabilities, and the manner of driving your vehicle. Participation with your own vehicle is entirely at your own risk.
4.2. With regard to vehicles used by BRP at its events, BRP will make every effort to comply with mandatory inspections, fire safety, permits, technical maintenance, etc. You realize that parts such as a wheel or steering wheel may break off, the brake may fail, the engine/fuel tank/pipes/fuel/oils may catch fire with all the consequences that entails. BRP cannot guarantee that the vehicles used are free of defects. You realize this and accept this risk.
4.3. By signing this form, you waive the right to make a claim against BRP, its employees, instructors, management, and the third parties engaged by it, if you suffer any damage of any kind, including injury or damage resulting from death, which arises from the use of a vehicle during an activity and/or if you participate with your own vehicle or if your vehicle is driven by an employee/instructor of BRP or if you have a collision with another vehicle on the circuit, track, course, and/or the associated (parking) areas.
5. Health risks during participation
The activities of BRP are strenuous activities. Therefore, you must be in good condition. Participation is not allowed if you have neck or back problems, are pregnant, have or have had heart problems, have poor physical condition, are short of breath, or have mental and/or physical defects or complaints. It is your own responsibility to assess whether or not you can participate. Participation is not allowed if you are under the influence of medication, drugs, and/or alcohol. You cannot hold BRP liable for this in any way.
6. Damage to property or third parties and own risk
6.1. In cases of reckless driving, collisions, cutting off, driving against track barriers, vandalism, etc., the other party, BRP, or third parties, including other participants, may hold you liable for all damages incurred. BRP bears no responsibility for damages and/or injuries caused by other participants. BRP reserves the right to exclude you from participation, without refund of participation fees.
6.2. You are obliged to comply with all instructions, indications, and regulations when participating in activities. If you fail to do so, BRP reserves the right to exclude you from participation, without refund of participation fees, and hold you liable for any damages. If you have not complied with the instructions and regulations, you must compensate for damages to persons or property caused by your actions on or around the location of BRP activities. You indemnify BRP against claims from persons visiting BRP activities through you.
6.3. If you have caused damage to BRP's vehicles while all instructions have been followed, and you have not driven recklessly or exhibited reckless behavior, BRP will not hold you liable for any damages. However, in the event of damage during activities at the Zandvoort circuit, you are still liable for an excess of €500. BRP excludes you from participation, without refund of participation fees.
7. Applicability of General Terms and Conditions
The General Terms and Conditions of BRP apply to the agreement and are enclosed. You can also find these on www.raceplanet.nl under general terms and conditions and will be sent to you upon request (free of charge). You declare to have read the content of the General Terms and Conditions and agree to them. This indemnity takes precedence over the content of the General Terms and Conditions regarding liability.
8. Declaration of valid driver's license B (not applicable for karting)
You declare to possess a valid driver's license B and that your driving authority has not been revoked or suspended.
